1.4 Binding Agreement: If you transact on the website, you agree to be bound by the Terms of Use.
1.5 Store Policies: You shall be subject to the policies that are applicable to the website and stores for such transactions and/or access.
1.6 Contractual Parties: By mere use of the website, you shall be contracting with BK Shop Ltd and these Terms of Use including the policies constitute your binding obligations with BK Shop.
Section 2. Definitions
Category A: Store Products and Goods
2.1. Physical Product(s) / NFC Figure(s): Mean tangible items—including interactive physical figures produced with integrated digital data or codes—which can be touched physically and can be shipped to Customer(s) after selling it, bought, sold or exchanged between a Customer(s) and BK Shop.
2.2. Digital Product(s): Means intangible items that exist in a digital format bought, sold or exchanged between a Customer(s) and BK Shop.
2.3. Custom & Personalised Product(s) / Custom-Made Product(s): Means goods that are made-to-order, custom-built, uniquely autographed, bespoke, hand-signed memorabilia, or limited-edition physical goods authenticated by or specifically altered, manufactured, tailored, personalised, and traded through BK Shop Ltd based on unique consumer specifications or selections.
2.4. Untested Product(s): Means items bought, sold or exchanged between a Customer(s) and BK Shop that are explicitly sold on the basis that they are not guaranteed to work or to be in a satisfactory condition.
2.5. Service(s): Means a specialised premium product upgrade or standalone service option purchased by a Customer, covering the physical costs, machinery operations, manual repair labour, and compounds used to clean or scratch-repair physical discs.
2.6. Mystery Pack(s) / Mystery Box(es): Means products sold as a curated, random, or semi-random assortment of goods packaged together under a single product listing, where the exact item identities, titles, variations, or market values of the individual contents are not disclosed to the Customer prior to purchase.
2.7. Voluntary Gratuity / Tip: Means an entirely optional financial contribution chosen and added by the Customer at checkout to support the ongoing operations, maintenance, and testing services of BK Shop Ltd.
Category B: Financial and Operational Fees
2.8. Postage Fee(s): Means the amount BK Shop charges to the Customer(s) for postage, packaging and any other costs relating to delivery.
Category C: Store Actions and Operations
2.9. Buying: Shall mean purchase of any product by a Customer from BK Shop.
2.10. Selling: Shall mean any product sold by a Customer to BK Shop.
2.11. Exchange: Shall mean an act of giving one thing and receiving another in consideration of cash, kind or donation.
2.12. Order(s): A variation of one or more Product-types purchased online to form and create an Order(s) with BK Shop.
Category D: Users and Corporate Platforms
2.13. User: Means a person who uses or accesses this website and/or is a customer.
2.14. Customer(s): Means a person or organisation that buys, sells or exchanges products with BK Shop online.
2.15. Affiliates: Means any website operator, retailer, direct marketing company, telemarketer, or operator of other direct marketing campaigns that has entered into an agreement with BK Shop which compensates the affiliate for transactions resulting from business directed to the BK Shop by the affiliate.
2.16. Personal Information: Means the details provided by you on registration or at the time you become a member and/or any subsequent information that you provide after or before the registration.
2.17. Cookies: Means small text files which our website places on your device to store information about your shopping session and to identify your device.

3.1.1. Second-Hand Inventory: All Product(s) are second hand unless specifically stated as new or custom-made. Internal consumable components—including rechargeable batteries, save-state backup batteries, and mechanical thumb stick tension—are subject to natural wear and tear. A reduction in factory-standard capacity or cosmetic casing wear does not constitute a fault.
3.1.2. Custom-Made & Personalised Inventory: Goods listed as custom-made, bespoke, or uniquely autographed are manufactured or modified to order. This explicitly covers uniquely autographed items, rare collectibles, and hand-signed physical memorabilia.
3.1.3. Mystery Box & Mystery Pack Inventory: Goods listed as mystery assortments are sold as randomised surprise collections. These boxes may contain a mixture of working second-hand stock, discontinued lines, or seasonal clearance stock.
3.1.4. Untested & Clearance Stock Inventory: Goods catalogued as “Untested Products” or “Faulty Clearance Stock” carry unverified functionality and are bound by the functional exclusions detailed in Section 3.3.3, Section 5.5.2, and Section 5.6.4.
3.1.5. Digital Products: Intangible assets (including guides, templates, or download codes) exist solely in a digital format. They are delivered electronically and require compatible hardware, software, and internet connectivity to access.
3.1.6. Service Options (Disc Repair): Represents a premium mechanical reconditioning service applied to physical media discs. This involves manual labour, machinery runtime, and specialised chemical compounds to clean or alleviate surface-level scratch damage.
3.2. Visual Representation and Illustrations
3.2.1. Display Purposes: All Product Descriptions and images on the Website are for display purposes only and do not represent the finished unique Product unless specifically stated.
3.2.2. Custom Asset Variance: For Custom-Made Products and hand-signed memorabilia, display images represent visual concepts and design templates. The actual finished bespoke item layout, natural material textures, vintage paper aging, paint or ink hues, and autograph placement may vary uniquely from the concept image.
3.2.3. Mystery Assortment Variance: Product images for Mystery Boxes or Packs are strictly illustrative of the types of items a box may contain. The actual selection of titles, variations, and physical editions received will vary completely due to the randomised nature of the stock.
3.2.4. Digital Product Previews: Mockups, previews, or screenshots of Digital Products are for conceptual reference only. The actual file layout or data formatting may vary slightly based on the digital delivery platform or software version used by the Customer.
3.3. Condition Grading, Execution, and Quality Control
3.3.1. Quality Control Audits: All physical items pass a manual quality control check before being packaged and sent. Any item falling below our satisfactory baseline will be specified in the individual Product Description.
3.3.2. Standard Grading Criteria: Standard second-hand products are graded based on being fully working, tested, and complete with no missing structural parts (unless specifically stated otherwise).
3.3.3. Untested and Faulty Clearance Condition: Items bought or sold under the “Untested” or “Faulty Clearance” categories are exempt from standard operational grading. Physical wear, missing original components, cosmetic defects, or complete functional failure are inherently part of the product’s graded description at the point of sale.
3.3.4. Disc Repair Service Expectations: The Customer explicitly acknowledges that disc reconditioning is a repair process, not a manufacturing process. While the service aims to restore functional readability to unplayable physical media, BK Shop Ltd makes no absolute guarantee that deep structural scratches, data-layer decay, or cracked discs can be completely restored or made cosmetically flawless.
3.4. Retail Packaging and Box Contents
3.4.1. Box Variations: Outer box retail packaging, artwork sleeves, and manuals for second-hand items may vary in condition, language edition, or colour.
3.4.2. Consumable Codes: Additional downloadable content (DLC), promotional codes, or digital tokens listed on physical second-hand retail boxes are explicitly presumed to have been already redeemed or expired.
Section 4. Buying from BK Shop
4.1. Compatibility & Safety: You hereby acknowledge your sole responsibility to ensure that you have the relevant compatible accessories, suitable power step-downs, equipment, software, display devices and relevant machinery or otherwise needed to safely connect the products to power supplies, mains power, batteries and other devices.
4.2. Quantity Limits: For the purposes of maintaining appropriate demand and supply and ensuring stock availability for the benefit of all our Customer(s), BK Shop reserves the right to limit the number of units of any particular item, sold to any individual customer, at any time.
4.3. Contract Formation: The display of products on our website represents an invitation to treat. A binding contract is only formed when BK Shop successfully dispatches your ordered items and sends a confirmation of shipment.
4.4. Order Refusal: BK Shop may cancel or decline an order prior to dispatch in case the Product(s) is unavailable from stock, proper payment has not been made, the Customer doesn’t meet eligibility criteria, or the Customer is in breach of the Terms of Use. In the event of an order cancellation prior to dispatch by us, a full refund of all payments received will be returned to the Customer.
4.5. Contract Cancellation Exceptions: An order for standard physical products can be cancelled by the customer up until the time it has been dispatched. This cancellation right strictly excludes the purchase of a Custom-Made Product or a Service(s) which has already commenced production, unique material sourcing, allocation, or execution.
4.6. Chargeback Abuse, Debt Recovery, and Litigation: If a Customer initiates a bank chargeback, payment dispute, or cardholder reversal request before contacting BK Shop Ltd support via email to resolve a claim, such action will be deemed a material breach of contract and an unlawful creation of a civil debt. BK Shop Ltd reserves the right to immediately block the user’s account, cancel pending shipments, and submit these Terms and Conditions directly to the merchant banking institution as binding evidence of contract compliance.
4.6.1. Right to Sue: BK Shop Ltd reserves the right to pursue the recovery of this debt through the County Court (Small Claims) or formal debt collection channels.
4.6.2. Recovery Costs: The Customer agrees to cover all reasonable costs associated with recovering the funds following a breach. This includes a standard £50.00 internal administrative debt processing fee, third-party debt collection agency commissions, statutory interest calculated under Section 69 of the County Courts Act 1984, and all court filing fees or legal representation costs incurred during litigation.
4.7. Voluntary Tipping and Gratuity Parameters: BK Shop Ltd provides an optional gratuity feature at checkout allowing Customers to add a voluntary tip to support the business. All tips are strictly opt-in and default to zero; no gratuity is required to complete a purchase. Because a tip represents a voluntary gift rather than a contractual payment for goods, any gratuity processed is immediately allocated to store operations and is strictly non-refundable, including in the event of an order cancellation, change-of-mind return, or product fault claim.
Section 5. Right to Cancel, Returns, and Faulty/Custom Goods Policy
5.1. Statutory Right to Cancel (Change of Mind): In accordance with the Consumer Contracts Regulations 2013, you have the right to cancel your purchase of an eligible physical item and request a return for any reason within 14 days from the day you receive physical possession of the goods.
5.2. Statutory Exclusions: This change-of-mind cancellation right strictly excludes all purchases of Custom-Made Products, Custom & Personalised Goods, hand-signed autographs/memorabilia, Digital Products (once download has started), and completed premium Services. Because Custom-Made Products and hand-signed collectibles are manufactured or uniquely customized to order, sales are strictly final and exempt from change-of-mind cancellations.
5.3. Cancellation Process for Eligible Goods: To exercise this right for eligible items, you must inform us of your decision to cancel using a clear statement (preferably via email to our designated customer support address) before the 14-day window expires. You then have an additional 14 days from that notice to return the goods to us.
5.4. Refunds on Cancellation: Upon valid cancellation of an eligible order, we will reimburse payments received from you, including standard delivery costs, within 14 days of receiving the returned goods or proof of return. You are responsible for the direct cost of returning unwanted change-of-mind items. If a delivery fails and is returned to us by the courier due to a customer’s failure to provide valid photographic identification under Section 18.5, the direct courier return transit surcharge will be subtracted from any eligible product refund.
5.5. Faulty, Damaged, or Custom Goods Claims: In accordance with the Consumer Rights Act 2015, if any product arrives faulty, damaged, or fundamentally not as described, you are entitled to a rejection, repair, or replacement.
5.5.1. Custom-Made & Personalised Goods Limitation: In accordance with UK statutory exemptions for bespoke items, a claim for a refund, repair, or replacement on a Custom-Made Product or autographed item is strictly limited to physical transit damage or a total failure to supply the core item ordered. Refund or rejection requests cannot be accepted based on subjective opinions of handwriting layout, aesthetic variations, minor natural material textures, autograph placement, paper aging, or a simple change of mind.
5.5.2. Untested Products Grading: Items explicitly listed, catalogued, and bought as “Untested Products” are sold “as is.” Rejection or refund claims based on the item failing to operate or function cannot be processed under a fault claim, as the functional defect is inherently part of the product description at the point of sale. Statutory 14-day change-of-mind rights remain unaffected.
5.5.3. Return Postage Reimbursement: If a standard or custom item is confirmed to be faulty or damaged upon return following an authorised verification check, BK Shop Ltd will provide a prepaid tracked return label or reimburse standard Royal Mail 2nd Class return postage costs up to the value of £4.50. Premium, special delivery, or unapproved courier costs will not be reimbursed.
5.5.4. Mandatory Email Reporting Steps for Damaged Items (Standard & Custom): If any item (including custom-made or autographed items) arrives physically damaged due to courier transit or mishandling, the Customer must notify us strictly via email to our designated customer support address within 7 days of the delivery date logged by the courier. To process a valid claim, the Customer must provide all of the following information within that email:
• Order Details: The full Order Number and the exact name of the specific product that is damaged.
• Outer Packaging Photos: Clear photographic evidence of the outer delivery envelope or box (clearly displaying the courier shipping label and any external dents, tears, punctures, or wrinkles).
• Inner Packaging Photos: Clear photographic evidence of how the item was secured inside the shipping box or envelope.
• Product Damage Photos: Clear, close-up photographic or video evidence showing the exact physical defects, broken cases, or cracks on the actual item, custom retail sleeve, photo print, or disc.
5.5.5. Verification of Transit Damage Claims: Customers are strongly urged to report transit damage and provide the mandatory photographic evidence requested in Section 5.5.4 within 7 days of delivery to facilitate corporate courier insurance validation. While statutory consumer rights under active UK legislation remain unaffected, any significant delay in reporting physical defects or outer packaging damage may severely limit our ability to independently verify that the damage occurred during courier transit rather than through subsequent consumer handling or misuse.
5.6. Mystery Pack and Mystery Box Provisions: Due to the inherent nature of blind-purchase products, special conditions apply to the sale and return of all Mystery Packs and Mystery Boxes:
5.6.1. Content Dissatisfaction: By completing a purchase of a Mystery Box or Pack, the Customer explicitly acknowledges and accepts that the product description comprises a randomised assortment. Dissatisfaction with the specific titles, variants, duplicates, or subjective aesthetic value of the contents received does not constitute a valid “faulty or not as described” claim under Section 5.5.
5.6.2. Strict Ban on Selective Returns: For any change-of-mind return executed under Section 5.1, the Mystery Box or Pack must be returned in its absolute entirety. BK Shop Ltd strictly prohibits selective returns. We will reject any return, withhold any refund, and block the user account for system abuse if a customer returns only a portion of a mystery box’s contents while retaining specific items.
5.6.3. Sealed Outer/Inner Packaging and Value Depreciation: If a Mystery Pack or Mystery Box is advertised and sold as a factory-sealed or foil-wrapped blind product, the Customer retains their statutory right to cancel under Section 5.1. However, the Customer explicitly acknowledges that the primary commercial value of a blind-purchase product relies entirely on its sealed, unverified state. If the protective security seal, outer foil, or product wrap is broken or opened, the physical and commercial value of the stock is severely diminished. In accordance with consumer distance-selling regulations, BK Shop Ltd reserves the right to reduce the Customer’s refund by an amount matching this explicit loss in value, which may equal up to 100% of the total purchase price.
5.6.4. Untested Contents Variance: Where a Mystery Box or Pack is explicitly advertised or catalogued as containing “Untested Items”, “Clearance Stock”, or “For Parts/Faulty Items”, the Customer explicitly acknowledges that individual item functionality is completely unverified. The presence of non-working, cosmetically damaged, or physically defective items inside the box is a core characteristic of the product description. Consequently, the failure of any internal item to operate, power on, or perform cannot be used as a basis for a “faulty or not as described” claim under Section 5.5.
5.7. Shortages and Missing Items Claims: If your order arrives with items missing that are listed on your invoice, you must let us know by emailing our customer support team within 7 days of the delivery date recorded by the courier.
5.7.1. Required Evidence for Missing Items: To help us process your missing item claim, you must provide the following details in your email:
- Order Details: Your full order number and the exact name of the missing product.
- Outer Packaging Photos: Clear photographs of the delivery box or envelope, showing the shipping label and its overall condition when it arrived.
Package Contents Photos: Clear photographs of all the items you did receive alongside the packaging, which helps us verify the package weight and packing records.
5.7.2. How We Resolve Shortage Claims: Once we verify a reported shortage against our warehouse dispatch logs, digital stock audits, and parcel weight records, BK Shop Ltd will issue a full refund for the missing item within 14 days. Please note that we do not send out replacement items for shortages. To ensure accurate verification, shortages should be reported within 7 days of delivery. BK Shop Ltd reserves the right to reject missing item claims if the delay in reporting prevents us from accurately cross-referencing parcel weights or courier tracking timelines..
5.7.3. Postage Cost Adjustments for Shortages: Because your original shipping fee was required to deliver the rest of the items in your order, outbound postage fees will not be refunded for partial shortages. If a shortage means your entire order is missing or cancelled, your outbound postage will be refunded in full.
5.8. Finality of Advertised Pricing and Pre-Dispatch Cancellations: All second-hand and custom product prices displayed on the Website are fully inclusive of the necessary order validation, stock allocation, and manual security checks required to prepare an item for fulfillment. In accordance with statutory online consumer rights, if an eligible order for standard stock is successfully cancelled by the Customer prior to physical courier dispatch under Section 4.5, a full refund of all payments received—including the product purchase price and standard outbound postage fees—will be returned to the Customer.
Section 6. Digital Products Licensing Parameters
6.1. Usage License: Digital Product(s) are for personal use only. You are granted one (1) non-transferable, non-sublicensable, non-exclusive license to use the Digital Product(s) you have purchased through the Sites.
6.2. Restrictions: You agree not to copy, reproduce, redistribute, alter, modify, share with third parties, display the content publicly, or create derivative works of Digital Product(s).
6.2.1. Abuse Detection Metrics: BK Shop Ltd utilizes automated digital fingerprinting, download link monitors, and IP tracking metrics to protect our exclusive digital assets.
6.2.2. Unauthorized Redistribution Enforcement: If our security filters detect anomalous access patterns—including duplicate downloads from conflicting physical locations or automated file scraping—the personal access link will be disabled. Your single-user usage license will be revoked instantly without a refund, and your user account will be permanently terminated under Section 9.2.
6.3. Templates: You may modify and use any Templates included in Digital Product(s) for business use without attribution to BK Shop.
6.4. Cancellation Waiver and Final Sales: In accordance with consumer law regarding specialised goods, by purchasing Digital Product(s) or Custom-Made Product(s) from BK Shop, you explicitly acknowledge and agree that all sales are strictly final and non-refundable.
6.4.1. For Digital Products, you expressly consent to immediate supply and waive your statutory 14-day right to cancel once the digital download or access stream has commenced.
6.4.2. For Custom-Made Products and autographed goods, due to the unique collectors’, tailored, or manufactured value, and the immediate risk of certificate of authenticity (COA) tampering, swap-fraud, or unique physical alteration degradation, these items are completely exempted from standard change-of-mind returns as detailed in Section 5.2. Once an order is processed or protective security packaging/seals are broken, you lose your statutory 14-day right to cancel.
6.5. Disclaimer: The content of all Digital Products is based on individual experiences, knowledge, and research under Fair Dealing principles. They have attempted their best to ensure the accuracy of the information; however, Digital Product(s) may contain inaccuracies, typos, or other errors. BK Shop assumes no responsibility for such errors and omissions.
6.6. No Advice: All Digital Product(s) are for general interest, education, and informational use only, and do not include legal or financial advice. BK Shop makes no guarantees you will attain a particular result and income using the ideas presented in the Digital Product(s).
6.7. Earning Claims: All statements of earning potential in sales and advertising material are individual personal opinions, not facts.
6.8. No Relationship: Your purchase and use of BK Shop(s) Digital Product(s) do not establish a professional working relationship between you, BK Shop or any associated or affiliated companies.
Section 7. International Orders and Exports
7.1. Import Duties, Taxes, and Customs: All orders shipped outside the United Kingdom may be subject to local import duties, value-added taxes (VAT), customs clearance fees, and administration charges levied by the destination territory.

Refusal of Delivery: If a Customer refuses to accept a delivery due to import fees or customs checks, the Customer remains liable for the original shipping costs, any return shipping fees incurred by BK Shop, and any administration charges. These costs will be deducted from any eligible refund.
7.5. Currency and Pricing: All transactions are processed in British Pounds Sterling (GBP) unless explicitly stated otherwise at checkout. BK Shop is not responsible for any currency conversion fees, bank charges, or exchange rate fluctuations applied by the Customer’s financial institution or payment provider.

8.1. Governing Law: These Terms of Use, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England.
8.2. Jurisdiction: The courts of England shall have jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms of Use, save that if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local home courts.

17.2. Allocation Resolution: In the event that our digital storefront processes simultaneous checkouts for a single stock unit, BK Shop Ltd reserves the right to allocate the item to the transaction first logged by our central server. Any secondary orders that cannot be fulfilled will be cancelled immediately prior to dispatch, and a full refund will be issued to the affected Customer.

Section 19. Selling and Trading to BK Shop
19.1. Ownership Warranty: By offering any item for sale or exchange to BK Shop Ltd, you warrant that you are the legal owner of the item, free from any third-party liens, and that the item is authentic and fully matches your submitted description.
19.2. Inspection, Rejection, and Involuntary Bailment: BK Shop Ltd reserves the right to physically inspect all received items before issuing a final cash payout or store credit voucher. If an item fails our internal quality control, is discovered to be counterfeit, or lacks critical retail components, the trade transaction will be rejected. The Customer is responsible for paying return courier costs. If a Customer fails to pay the return costs or respond within 30 days, BK Shop Ltd will issue a formal statutory notice under the Torts (Interference with Goods) Act 1977. If the items remain uncollected after the statutory period specified in the notice, BK Shop Ltd reserves the right to dispose of or sell the stock to clear storage costs.
19.3. Valuation Adjustments and Condition Discrepancies: If a received trade-in item passes core functional testing but fundamentally fails to match the cosmetic grading criteria or product condition originally submitted by the Customer online, the transaction will be subject to a valuation revision.
19.3.1. Amended Offer Timeline: BK Shop Ltd will issue an amended valuation quote via email based on the actual physical condition of the stock. The Customer has strictly 7 days from the timestamp of that email to manually accept the revised valuation or reject it.
19.3.2. Expiry of Revised Offers and Trade Cancellation: If the Customer explicitly rejects the revised quote, they must pay the necessary return courier costs to have the items sent back. If the Customer fails to respond, accept the quote, or pay return shipping within 14 days of the date the email was sent, the revised offer will automatically expire and the trade transaction will be cancelled. Following cancellation, the items will be treated as uncollected stock and handled in strict accordance with the statutory notice and disposal procedures detailed in Section 19.2
